31 year old mason found guilty of sexual intercourse with minor

A 31-year-old mason was found guilty of having sex with a minor. She was 13 years old at the time. The case will be called again on October 23, 2019 for the pleadings around the sentence of the inhabitant of Poste-de-Flacq. The mason had pleaded not guilty.

According to the indictment, the offense was committed on 4 October 2013 in a villa in Belle-Mare. In the version he gave to the police, the mason reported that he started going out with the teenager in January 2013. They were in regular communication on the phone. They had met twice in September 2013.

According to the inhabitants of Poste-de-Flacq, on October 4, 2013, the teenager informed her that she had run away from home. They had then gone to a villa in Belle-Mare with a friend of the teenager and the uncle of the accused. It was there that the mason and the teenager had sex.

During the trial, the prosecution called the complainant to the stand. The latter indicated that she did not want to follow up on the complaint she had filed against the mason. She added that she no longer had any feelings for him and that she did not want to go back to what had happened.

The accused also testified under oath. He admitted having sex with the teenager and was aware that she was 13 at the time. He however retracted in court. In his testimony, the accused stated that the complainant had told her that she was 18 years old and that her body size suggested that she was under 16 years old.

In her verdict, Magistrate Adeelah Hamuth pointed out that the defense did not dispute the content of the accused's statement including confessions. The court ruled that the accused does not seem to be an honest person by his explanations. The mason was therefore found guilty.
